Terms: By accessing this Web Site, you are agreeing to be bound by these Web Site Terms of Service ("TOS") and Privacy Policy (together, "Terms and Conditions of Use"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law. The Web Site is available only to individuals who are at least 13 years old.
Definitions: TheHappyDogPlace.com ("THDP") is an interactive network of people and their dogs owned and operated by Publishing Pros Corp. ("PPC") on the World Wide Web of the Internet. Any mention of THDP in this TOS applies equally to PPC and vice versa. The focus of TheHappyDogPlace.com is a community devoted to finding out what makes dogs happy in order to help keep them in their homes. Advertising and/or additional content may be provided by our affiliates and other third parties.
Site Terms of Use Modifications: THDP may revise its TOS at any time without notice. By using this Web Site you are agreeing to be bound by the then current version of this TOS. It is solely your obligation to have read the Agreement.
Disclaimer: The materials on THDP's Web Site are provided "as is". THDP makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, THDP does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet Web Site or otherwise relating to such materials or on any sites linked to this site.
Limitations: In no event shall THDP, PPC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on THDP's Internet site, even if THDP or a THDP authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Links: THDP has not reviewed all of the sites linked to its Internet Web Site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by THDP of the site. Use of any such linked Web Site is at the user's own risk.
Responsibility of Contributors: If you are a Guest or a Member and post material to all areas of the Web Site, or otherwise make (or allow any third party to make) material available by means of the Web Site (any such material, “Content”), You are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of whether the Content in question constitutes text, graphics, an audio file, or computer software.
By making Content available, you represent and warrant that:

By submitting Content to THDP you grant a world-wide, royalty-free, and non-exclusive license to reproduce, adapt and publish the Content for the purpose of displaying, distributing and promoting it. You also grant THDP the right to place in context ads within the body of your Content and to display ads which it deems appropriate. If you delete Content, THDP will use reasonable efforts to remove it from the Web Site, but you acknowledge that caching or references to the Content may not be made immediately unavailable.
Without limiting any of those representations or warranties, THDP has the right (though not the obligation) to, in its sole discretion, (i) refuse or remove any content that, in its reasonable opinion, violates any THDP policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Web Site to any individual or entity for any reason, in THDP’s sole discretion.
Severability: If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof.
Governing Law: Any claim relating to Publishing Pros Corp.'s web site shall be governed by the laws of the State of Delaware, U.S.A. without regard to its conflict of law provisions.
